Central Armed Police Forces Act Comes into Force
The Central Armed Police Forces (General Administration) Act, 2026, came into force on 8 October 2026 after a notification by the Union Ministry of Home Affairs. The Act establishes a common framework for recruitment and service conditions of Group A general duty officers and other officers in the Central Armed Police Forces (CAPFs). Serving CAPF officers have challenged its constitutional validity in the Supreme Court.
Statutory framework and commencement
Parliament passed the Bill in April 2026, and President Droupadi Murmu gave assent on 9 April 2026. The Bill was introduced in the Rajya Sabha on 27 March, passed there on 1 April, and passed by the Lok Sabha on 2 April. The Union government appointed 8 October 2026 as the commencement date through a Gazette notification.
The Act governs the administration and functioning of the CAPFs. The government stated that a common law would address fragmented service regulations and related administrative difficulties.
CAPF service structure and deputation
The Act sets the share of senior posts available to officers deputed from the Indian Police Service (IPS). Its provisions reserve 50 per cent of Inspector General posts and at least 67 per cent of Additional Director General posts for IPS officers; Director General and Special Director General posts are reserved for IPS officers. CAPF cadre officers have argued that these provisions limit their progression to senior leadership positions.
The Union government has stated that IPS deputation supports CAPF operations and coordination between the Union and the States. IPS is an All India Service under Article 312 of the Constitution, and its officers serve in both Union and State roles.
Judicial proceedings and constitutional context
On 23 May 2025, the Supreme Court directed the Centre to progressively reduce IPS deputation to senior CAPF posts and conduct a cadre review to support timely promotions. The Centre’s review petition was dismissed on 28 October 2025. CAPF officers contend that the 2026 Act conflicts with the Court’s directions.
A Supreme Court special bench comprising Justices Manoj Misra and Ujjal Bhuyan is scheduled to hear petitions challenging the Act and related contempt petitions on 15 October 2026.
