Registration of Births and Deaths Amendment Act from October 1

Key Changes in the 2026 Amendment

The 2026 amendment tightens the procedure for delayed registration of births and deaths. For delays of more than one year but within two years, an order from a District Magistrate, Sub-Divisional Magistrate, or an authorised Executive Magistrate remains necessary, along with verification and a prescribed fee. For registrations delayed by more than two years, the new law requires an order from a Judicial Magistrate of the First Class. This provision replaces the earlier framework for long-delayed registration and applies to both births and deaths.

Database and Legal Identity Use

The previous amendment to the Registration of Births and Deaths Act, 1969, came into force on 1 October 2023. That amendment introduced a national births-and-deaths database for registration records. A birth certificate issued under the Act is used as primary legal identity for school admission, Aadhaar, passport, and electoral roll-related purposes. The certificate is also used in civil registration and identity verification processes in India.
