Government Amends Insurance Ombudsman Rules

The Ministry of Finance notified amendments to the Insurance Ombudsman Rules, 2017, on 2 March 2021. The rules relate to the redressal of policyholder complaints in the insurance sector in India.

Insurance Ombudsman Framework

The Insurance Ombudsman system provides a low-cost grievance redressal mechanism for insurance policyholders. It functions outside ordinary civil courts and deals with complaints against insurers and insurance intermediaries. The 2021 amendments expanded the scope of the Ombudsman from disputes alone to deficiencies in service. The revised framework covers insurers, agents, brokers, and other intermediaries involved in insurance services.

Key Procedural Changes

The amended rules allowed policyholders to file complaints electronically. They also permitted online tracking of grievance status and participation in hearings through videoconferencing. The rules were designed to make the complaint process more accessible and time-bound. The framework also retained the objective of impartial resolution of insurance grievances.

Institutional Changes

The Government renamed the Executive Council of Insurers as the Council for Insurance Ombudsmen in March 2021. This body serves as the administrative structure for the ombudsman mechanism. The selection committee for Ombudsman appointments was modified to include a person with a record of promoting consumer rights. This change was made to strengthen the independence of the selection process.

The Ministry of Finance released the Draft Insurance Ombudsman (Amendment) Rules, 2025, on 25 November 2025. The draft proposed a two-tier redressal structure with an Appellate Authority constituted by the Insurance Regulatory and Development Authority of India. The draft also proposed stricter compliance for insurers and brokers that fail to comply with an Ombudsman award within 30 days. The draft remained under discussion in 2026.
