The Parliament recently approved the National Capital Territory of Delhi Laws (Special Provisions) Second (Amendment) Act, 2023, extending the protection for unauthorised constructions for an additional three years. This move aims to shield structures in slums, farmhouses, and other colonies in Delhi from official actions.

Bill Overview and Extension Period

The legislation, passed through a voice vote in the Lok Sabha, extends the protection period for unauthorised buildings from January 1, 2024, to December 31, 2026. The decision follows a brief discussion involving only three members, one of whom represented the Opposition. Notably, this was the first bill addressed after the suspension of 49 Opposition MPs from the Lower House.

PM-UDAY Scheme and Covid-19 Impact

The PM-UDAY scheme was introduced in October 2019 to regularise unauthorised colonies. However, the progress was hindered by the Covid-19 pandemic. Presently, over 40 lakh people have benefited, and the extension will continue to provide benefits to more sections.

Land Pooling and City’s Growth

Delhi is currently witnessing exponential economic progress as well as increased population growth. The Bill is expected to benefit over 70 lakh people. The three-year extension allows time for extensive consultations to ensure the orderly development of unauthorised colonies.

Master Plan 2041 and Continuing Protection

The Bill aligns with the finalization of the Master Plan for Delhi with a perspective year of 2041. This plan includes measures for addressing unauthorised developments like slum clusters and colonies. The legislative extension acknowledges that dealing with these developments requires additional time, justifying the need for continued protection from punitive actions.
