Red Bull Challenges FSSAI Order on Energy Drink Label

Red Bull moved the Delhi High Court on 25 September 2026 against a 30 June 2026 order of the Food Safety and Standards Authority of India (FSSAI) that directed the removal of the “Energy Drink” label from its products. The case was heard on 28 September 2026 before Justice Amit Mahajan, who asked whether a show-cause notice or hearing had been given before the order was issued.

FSSAI Label Regulation

The FSSAI order covered Red Bull and other brands, including Sting, Adrenaline Rush, Campa Gold Boost, Hell Energy, and Monster. The order required the removal of the “energy” descriptor within 90 days and stated that FSSAI does not recognise “energy drink” as a separate category under its labelling framework.

FSSAI had earlier suggested the use of the term “caffeinated beverages” for such products. The Indian Beverage Association has opposed that term on the ground that it is broad and covers multiple product types.

Red Bull’s Petition and Regulatory Context

Red Bull stated that the 30 June 2026 order was issued without prior notice or hearing. The petition also referred to a 17 July 2026 FSSAI communication that led to enforcement action, including product seizures in India.

The company cited a March 2024 FSSAI advisory and an April 2024 Union Health Ministry press release, which it claims allowed the use of “Energy Drink” for products licensed as caffeinated beverages. Red Bull has sold products in India since 2002 under the “Energy Drink” label.

Delhi High Court Proceedings

The Delhi High Court did not grant interim protection to Red Bull on 28 September 2026. The matter was listed for further hearing on 29 September 2026.
