Do the emergency provisions modify the federal character of the Indian constitution?

No, the emergency provisions do not modify the federal character of the Indian Constitution. It is rather a merit of the constitution that is visualizes the contingencies when the strict application of the federal principle might destroy the basic assumption on which our constitution is built. Emergency provisions are designed for temporary use only, by their very nature they cannot be of normal occurrence. Further, in an emergency, the behaviour of each federal Constitution is very different from that in peace-time.
