Delhi Notifies Transgender Rights Protection Rules 2025

The Delhi government has recently notified the Delhi Transgender Persons (Protection of Rights) Rules, 2025. This marks step towards safeguarding the rights and welfare of transgender persons in the national capital. The notification empowers district magistrates to issue identity certificates to transgender individuals and establishes a dedicated welfare board for their empowerment.

Issuance of Identity Certificates

Under the new rules, district magistrates must issue a certificate of identity to transgender persons within 30 days of receiving a complete application. This certificate serves as official recognition of their gender identity. The process aims to simplify access to government schemes and legal protections.

Formation of Transgender Welfare Empowerment Board

The Delhi government will constitute a Transgender Welfare Empowerment Board. The social welfare minister will act as the ex officio chairman. The board will include representatives from key government departments such as home, finance, planning, law, labour, health, higher education, education, and revenue. Additionally, three members from non-governmental organisations working for transgender welfare will be part of the board. This multi-stakeholder body will coordinate policies and oversee the implementation of welfare measures.

Legal Framework and Historical Context

The rules align with the Transgender Persons (Protection of Rights) Act, 2019, enacted by the Government of India. However, the previous Delhi government had not adopted these rules. The 2025 notification reflects renewed commitment to transgender rights and inclusion at the state level.

Demographics and Voter Registration

Accurate data on the transgender population in Delhi remains limited. The 2011 Census recorded approximately 4,200 transgender persons in Delhi. Current estimates are unavailable. Registered transgender voters number just over 1,200, indicating low electoral participation and potential under-registration.

Significance for Transgender Rights

The notification is expected to enhance legal recognition and social inclusion of transgender individuals. Identity certificates will facilitate access to education, healthcare, employment, and social security schemes. The welfare board will provide a platform for addressing grievances and shaping policies tailored to transgender needs.
