Supreme Court Reduces Judicial Service Practice Requirement to 1 Year
The Supreme Court of India reduced the mandatory active bar practice requirement for entry-level judicial service candidates from three years to one year for Civil Judge, Junior Division posts. The decision came in a 2:1 split verdict delivered by a three-judge bench on a review petition and modified the court’s earlier judgment of May 20, 2025.
Judicial Service Entry Rules
Judicial service recruitment in India is governed by eligibility conditions prescribed for entry-level posts in the subordinate judiciary. Civil Judge, Junior Division is the usual entry post in many State judicial services, and the bar practice requirement has been a recurring qualification issue in recruitment rules and court rulings.
Training and Clerkship Requirements
The bench directed that selected candidates must complete one year of intensive training at their respective State Judicial Academies. The court also required a six-month clerkship under a District and Sessions Judge and another six-month clerkship under a sitting High Court judge. These post-selection training components are linked to judicial induction and courtroom exposure. State Judicial Academies function as training institutions for judicial officers in several States and Union Territories.
Review Petition and Majority View
The verdict was delivered by Chief Justice of India Surya Kant, Justice August George Masih, and Justice K. Vinod Chandran. Justice K. Vinod Chandran dissented from the majority view and stated that classroom training cannot replace experience gained through active practice at the bar. The court also created a transitional waiver for candidates appearing in judicial examinations notified between May 20, 2025, and March 31, 2027. These candidates do not need to produce a practice certificate for that period.
