RBI Revises Loan Recovery Rules
The Reserve Bank of India (RBI) issued nine circulars on 6 August 2026 to create a unified framework called the Amendment Directions for loan recovery practices. The directions apply from 1 January 2027, after the original proposed date of 1 October 2026 was deferred to allow lenders time for transition.
Loan Recovery Framework
The RBI is India’s central bank and the regulator of banks, non-banking financial companies, and several other financial institutions under the Reserve Bank of India Act, 1934. Loan recovery rules in India cover communication with borrowers, use of recovery agents, and the treatment of overdue accounts under banking and fair-practice norms.
Recovery Call and Visit Norms
Under the new directions, recovery-related phone calls and physical visits are permitted only between 8:00 AM and 7:00 PM. Lenders must give a borrower at least one day’s notice before the first physical visit by a recovery agent. The rules also require lenders to record all recovery calls and preserve the recordings for a minimum period of six months.
Digital Device Locking Rules
The updated framework places limits on the remote locking of financed devices such as mobile phones and tablets. A lender cannot use technology to lock such a device until the account is at least 30 days overdue, and a complete lock is allowed only after 60 days of non-payment. Locked devices must continue to support incoming calls, SMS, and emergency SOS services.
