TRAI Tightens Anti-Spam Rules with AI Detection

The Telecom Regulatory Authority of India (TRAI) strengthened its framework on Unsolicited Commercial Communications (UCC) on 18 September 2026 in New Delhi. The amended rules bring AI-based detection of suspected spam, a consumer appeal mechanism, and new compliance duties for telecom service providers and entities using automated calling systems.

Unsolicited Commercial Communications and Telecom Regulation

Unsolicited Commercial Communications are commercial messages or calls sent without the recipient’s consent under telecom rules in India. TRAI regulates telemarketing, spam calls, and commercial messaging through the Telecom Commercial Communications Customer Preference Regulations and related amendments.

Telecom service providers must identify numbers with a high probability of sending spam and share such information across operators. If five or more numbers linked to a sender are flagged within 10 days, graded action can include KYC re-verification, physical verification, barring of outgoing services, and disconnection for repeated violations.

Application-to-Person Calls and Automated Dialling

TRAI has defined Application-to-Person (A2P) calls as calls initiated by applications, software systems, or automated platforms without direct human dialling. Autodialling, robocalls, pre-recorded voice calls, and artificial voice calls fall within this category.

Entities using A2P calls must pre-declare the use of such systems and the associated numbers to their telecom service provider. Undeclared A2P calls are treated as UCC under the amended framework.

A termination charge of up to 5 paise per minute applies to A2P calls, with exemptions for calls made through designated numbering series for regulated commercial calls and authority-authorised calls.

AI-Based Spam Detection and Consumer Complaints

In the first quarter of FY2026-27, AI-based systems used by telecom operators flagged 22.99 billion incoming calls as suspected spam out of about 721.79 billion incoming calls. TRAI has also required call-management applications to avoid blanket blocking of specific regulated commercial call series.

Consumers filed 3.1 million UCC complaints in 2025 through different channels, including 1.7 million complaints through the TRAI DND app. TRAI issued more than 7.31 lakh notices to unregistered telemarketers in the same period.
