“There is a need for simplification of procedure for disqualification of persons found guilty of corrupt practices under the Representation of the People Act.” Comment. (UPSC 2020)
Corrupt practices undermine free and fair elections, so disqualification must be prompt and certain. However, under the Representation of the People Act, the current process is slow and layered, reducing deterrence.

- Problem: After a High Court finds a candidate guilty under Section 99, the matter goes to the President and the Election Commission under Section 8A, causing delay and inconsistency.
- Need for reform: Since many offences under Section 8(3) trigger immediate disqualification, corrupt practices too should lead to automatic disqualification on judicial finding, for a fixed period, subject to appeal.
This would strengthen electoral ethics, curb abuse of office and ensure equality before law, while preserving fair hearing and judicial review.
