The Governor of Uttarakhand recently issued an ordinance to control unfair recruitment in the state. In accordance with the ordinance, the State Government can impose fines of up to 10 crores of rupees against unfair practices in exams and in recruitment. Since 2016, there were multiple paper leaks in the state.
Features of the law
- The ordinance is applicable to all the public examinations conducted by the state government and also to the autonomous bodies that come under the purview of the state government
- If an examinee cheats during the exam, he shall be imprisoned for 3 years and fined a minimum of 5 lakh rupees
Other persons punishable under the law
- Presses that are printing the question paper fraudulently
- Service providers or contractors who conduct the exam
- Management that is conducting the exam
- Coaching centres
- Vehicles carrying unauthorized exam materials
- Organizations that hold the question paper illegally
Provision for the applicant
The applicants found cheating shall not write any competitive exam for ten years. He or she will be non-bailable.
Need of the law
Cheating in exams compromises merit, increases corruption in the country, reduces the overall efficiency of the youth, discourages hard work, and ultimately creates an immoral and unethical society which is not good for the future citizens of the country. The law is required to discourage cheating practices and to maintain the quality of academics
