The Gujarat High Court has held that the special law ” Prohibition of Child Marriage Act (PCMA), 2006″ will prevail over the Muslim Personal Law in cases where Muslims marry off their minor daughters. The promoters of such marriages will face legal proceedings. The ruling held that the Child Marriage Act is a Special Act and it will override the provisions of Muslim Personal Law, Hindu Marriage Act or any personal law. The ruling was made by Justice JB Pardiwala.
