  • The court struck down Section 33(2) of the Aadhar Act which allows disclosure of information of a user in the interest of national security. However, the court held that the power of determination of such an eventuality should be given to an officer higher than the rank of a Joint Secretary.
  • Section 33(1) of the Aadhar Act which prohibits disclosure of information, including identity and authentication information, except when it is by an order of a district judge or higher court, the court ordered that an individual, whose information is sought, shall be afforded an opportunity of hearing.
  • Section 47 of the Aadhaar Act refers to cognizance of offences. No court is allowed to take cognizance of any offence punishable under this Act, except on a complaint made by the authority of officer or person authorised by it. The Section also disallows courts below that of a Chief Metropolitan Magistrate or a Chief Judicial Magistrate to try any offence punishable under this Act.
  • Section 57 of the Aadhaar Act refers to the use of Aadhaar data by any “body corporate or person” to establish the identity of an individual. It was held unconstitutional. It was under this provision that private companies like Paytm and Airtel Payments Bank sought Aadhaar details from customers.

  •  Deep tech startups are likely to be based on artificial intelligence or machine learning like block-chain, computer imaging, and VR. Examples of deep tech might include AI applied to predict natural disasters or molecular imaging technologies that identify disease or predisposition to disease far before any other existing test possible could.
