The pardoning power of the Governor is different from President in India because:
1. While President can pardon a death sentence given under central as well as state laws, Governor can pardon only in case of state law
2. While president can pardon a sentence by Military Court, Governor has no such powers
Which among the above statements is / are correct?
Governor cannot pardon a death sentence. Even if a state law prescribes for death sentence, the power to grant pardon lies with the President and not the governor. But, the governor can suspend, remit or commute a death sentence. He does not possess any such power.
